Terms of Service

1. Acceptance of Terms

By accessing or using TechBouts ("the Platform"), operated by Nak Muay Foundation, a 501(c)(3) tax-exempt nonprofit organization (EIN: 86-3519707), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform.

2. Description of Service

TechBouts is a combat sports platform that provides event management, fighter and gym profiles, bout record tracking, rankings, and related services for the combat sports community. The Platform serves promoters, sanctioning bodies, gyms, coaches, fighters, and officials.

3. User Accounts

• You must provide accurate and complete information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activity that occurs under your account.
• You must be at least 18 years old to create an account. Minors may have profiles created on their behalf by a parent, guardian, or authorized coach for event participation purposes.
• We reserve the right to suspend or terminate accounts that violate these terms.

4. User Roles & Responsibilities

Promoters & Event Organizers

• You are responsible for the accuracy of event information, results, and scores submitted through the Platform.
• You must comply with all applicable local, state, and federal regulations governing combat sports events.
• You are responsible for obtaining all necessary permits, licenses, and insurance for your events.

Gym Owners & Coaches

• You are responsible for the accuracy of gym profiles, coach information, and fighter rosters you manage.
• You must have appropriate authorization to manage profiles and submit information on behalf of fighters, especially minors.

Fighters

• You acknowledge that bout records, results, and rankings are publicly visible on the Platform.
• You are responsible for verifying the accuracy of your own records and reporting discrepancies to your coach or event promoter.

5. Content & Data

• By submitting content (profiles, photos, event data, bout records) to the Platform, you grant Nak Muay Foundation a non-exclusive, royalty-free license to use, display, and distribute that content in connection with operating the Platform.
• You must not upload content that is unlawful, defamatory, harassing, or that infringes on the rights of others.
• Bout records and event results submitted to the Platform become part of the public record and may be retained even if your account is deleted, as they are integral to the historical record of combat sports events.
• You must not scrape, harvest, or programmatically extract data from the Platform without written permission.

6. Donations & Payments

• Donations to Nak Muay Foundation through the Platform are tax-deductible to the extent allowed by law.
• Payments are processed by Stripe. By making a payment, you also agree to Stripe's Terms of Service.
• Event registration fees, when applicable, are set by promoters and processed through the Platform. Refund policies for event fees are determined by the respective promoter.
• Nak Muay Foundation reserves the right to modify pricing and fee structures with reasonable notice.

7. Prohibited Conduct

You agree not to:

• Use the Platform for any unlawful purpose or in violation of these Terms.
• Submit false or misleading information, including fabricated bout records or fighter credentials.
• Attempt to gain unauthorized access to other users' accounts or Platform systems.
• Interfere with or disrupt the Platform or its infrastructure.
• Use the Platform to harass, threaten, or intimidate other users.
• Impersonate any person, gym, or organization.

8. Assumption of Risk

Combat sports involve inherent risks of physical injury. TechBouts is a technology platform for event management and record keeping only. Nak Muay Foundation does not organize, sanction, or oversee the physical conduct of any combat sports events or training. Participation in any event listed on the Platform is at your own risk, and you should ensure proper medical clearance, insurance, and safety measures through your event promoter and sanctioning body.

9. Disclaimer of Warranties

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. Nak Muay Foundation does not warrant that the Platform will be uninterrupted, error-free, or free of harmful components. We do not guarantee the accuracy of rankings, records, or third-party content displayed on the Platform.

10. Limitation of Liability

To the fullest extent permitted by law, Nak Muay Foundation, its directors, officers, volunteers, and contributors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, including but not limited to injuries sustained during events, loss of data, or inaccuracies in records or rankings.

11. Indemnification

You agree to indemnify and hold harmless Nak Muay Foundation and its directors, officers, volunteers, and contributors from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of another party.

12. Changes to Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated revision date. Continued use of TechBouts after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved in the courts located in the State of California.
